Work with Congress to pass permanent legislative protections for the Section 106 review process before these proposed regulatory changes take effect. An advisory council with 21 of its 24 members appointed by President Trump just voted to gut the National Historic Preservation Act — making tribal consultation optional, eliminating public comment requirements, and narrowing protections so broadly that landscapes like the Grand Canyon could lose federal historic status. This cannot be fixed through rulemaking alone. Over 10,000 cultural resources professionals depend on the Section 106 process to do their jobs, and the National Register of Historic Places protects more than 1.8 million buildings, structures, sites, and districts across this country. The National Trust for Historic Preservation, the National Association of Tribal Historic Preservation Officers, and the National Conference of State Historic Preservation Officers have all opposed these changes. The proposed revisions are still moving through federal rulemaking, which means there is still time to act. Legislation that codifies the existing consultation framework is the only durable protection against an administration determined to dismantle it.
