We Cannot Allow the Government to Exile Americans

To: Rep. Self, Sen. Cruz, Sen. Cornyn

From: A constituent in Plano, TX

April 13

Dear Honorable Representatives, I am writing to you as a deeply concerned constituent regarding recent remarks made by White House Press Secretary Karoline Leavitt. According to her statement, President Donald Trump is exploring legal pathways to deport U.S. citizens to El Salvador—a move that is both unprecedented and fundamentally un-American. Leavitt claimed this proposal would initially target “heinous, violent criminals,” but the president has already hinted that the scope could extend to individuals accused of lesser offenses. The very suggestion of deporting American citizens—people born and raised in this country, who hold full constitutional rights—is not only morally outrageous, but legally baseless. It strikes at the heart of our nation’s foundational principles. Let me be clear: There is no legal authority that permits the United States government to expel its own citizens. Such a policy would be an egregious violation of the Constitution, particularly the Fourteenth Amendment, which guarantees citizenship rights and equal protection under the law. Furthermore, the proposal to send citizens to El Salvador—a country where U.S.-deported immigrants are currently held in prisons widely condemned for human rights abuses—adds another layer of inhumanity. The idea that we would outsource punishment to foreign governments to "save taxpayer money" is appalling. The use of the Alien Enemies Act of 1798 to deport immigrants, based on vague or unsubstantiated associations with gangs, is already deeply troubling. But extending this to American citizens under any legal pretext would signal the collapse of the rule of law in our country. No administration should have the power to unilaterally exile its own people. I urge you to take immediate and public action against this dangerous idea. I ask that you: Publicly condemn the proposal to deport U.S. citizens as unconstitutional and authoritarian. Introduce or support legislation explicitly prohibiting the use of any federal authority to deport citizens of the United States. Demand congressional oversight and transparency regarding the administration's use of the Alien Enemies Act and any agreements with foreign governments related to the detainment of individuals sent from the U.S. This is not a partisan issue. It is a fundamental test of our nation's values and commitment to due process, civil rights, and human dignity. I urge you to stand firmly on the side of the Constitution and the rights of every American. Thank you for your time and service. I look forward to your leadership on this matter.
