Directing Homeland Security Investigations (HSI) special agents to audit state voter rolls diverts critical capacity away from urgent, high-stakes investigations. HSI is the premier federal agency tasked with dismantling transnational cartels, halting human trafficking, interdicting illicit fentanyl, and rescuing children from online sexual abuse. While backlogged child exploitation cases wait months for investigative action, pulling federal agents to comb through local voter files actively compromises public safety and weakens our defense against violent criminal networks. Furthermore, these federal interventions intrude upon the clear constitutional authority granted to states to administer elections and maintain voter rolls under Article I, Section 4. Decades of comprehensive audits, multi-state reviews, and Department of Justice findings have consistently demonstrated that noncitizen voting is exceptionally rare, deterred by severe felony penalties and mandatory deportation. The sensational claims alleging massive noncitizen registration rely on flawed commercial database cross-matching, which is notorious for false positives, not credible evidence. Weaponizing specialized federal investigators for non-existent voter fraud wastes taxpayer dollars, creates unfunded administrative burdens, and distracts from pressing national security priorities. I urge you to take immediate legislative and oversight actions: 1. Enact Strict Appropriations Riders: Insert binding statutory language into DHS and DOJ appropriations bills prohibiting federal funds from being spent on auditing, acquiring, or cross-referencing state voter rolls with third-party databases, absent an individualized criminal predicate. 2. Mandate Statutory Data & Privacy Safeguards: Amend federal statutes to establish clear legal standards restricting the transfer of state voter files to non-election federal agencies and barring the use of unverified commercial matching methodologies. 3. Require Resource Allocation Reporting: Demand formal accountability hearings and require DHS to submit a comprehensive accounting of special agent hours and operational funds diverted away from core mission areas—specifically child exploitation (CSAM), human trafficking, narcotics interdiction, and cybercrime. 4. Reaffirm State Constitutional Authority: Codify statutory protections under Article I, Section 4 that prevent federal executive agencies from encroaching on state and local election administration authority. Please focus federal law enforcement on keeping our communities safe from real, dangerous threats, and leave election administration to the state and local officials legally charged with that duty.
