I am writing to you today with absolute outrage regarding the administration’s blatant attempt to dismantle the Presidential Records Act (PRA) through the recent, legally bankrupt Office of Legal Counsel (OLC) memorandum. This is not merely a policy disagreement; it is a scorched-earth assault on the very foundation of government accountability and the rule of law. By declaring the PRA "unconstitutional," this administration is attempting to privatize history. The records of the presidency belong to the American people, not the individual occupying the office. The DOJ’s assertion that the President “need not comply” with record preservation is a green light for the wholesale destruction of evidence, the concealment of corruption, and the permanent erasure of executive branch decision-making from the public record. I demand that you immediately and publicly: - Support the American Historical Association’s Lawsuit: Formally back the litigation brought by the AHA and American Oversight (Am. Historical Ass’n v. Trump, D.D.C., No. 26-cv-1169) to affirm the constitutionality of the PRA. - Exercise Congressional Oversight: Hold emergency hearings to investigate the OLC’s attempt to bypass decades of Supreme Court precedent (notably Nixon v. Administrator of General Services). - Legislative Protection: Introduce or co-sponsor legislation that reinforces the PRA and imposes criminal penalties for the intentional destruction or withholding of presidential records. History is watching. If you allow the executive branch to unilaterally decide which of its actions remain public and which are "personal property," you are complicit in the death of government transparency.
