I am writing to express my deep concern about recent statements and actions by current sitting President Donald J. Trump that suggest he may attempt to seek a third term in office or run for vice president in the 2028 election. These possibilities, while constitutionally prohibited, are being openly discussed by Mr. Trump and his allies, and I urge you to take all necessary steps to defend the Constitution and uphold democratic norms.
Despite the clear language of the 22nd Amendment, which states that “No person shall be elected to the office of the President more than twice,” Mr. Trump has repeatedly teased the idea of serving beyond two terms. On October 27, 2025, he told reporters aboard Air Force One:
“I would love to do it. I have my best numbers ever.”
“Am I not ruling it out? I mean, you’ll have to tell me.”
He has also dismissed the idea of running as vice president as “too cute,” but not because it’s unconstitutional — rather, because he believes “people wouldn’t like that.”
These comments are not isolated. Mr. Trump has previously said:
“It will be the greatest honor of my life to serve not once, but twice or three times or four times.”
— a statement he later claimed was a joke aimed at the “fake news media.”
His allies, including Steve Bannon, have gone further, stating:
“Trump is going to be president in ’28, and people ought to just get accommodated with that.”
This rhetoric is deeply troubling. Legal scholars have made it clear that Trump is constitutionally ineligible to be elected president again, and the 12th Amendment bars him from serving as vice president:
“No person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”
Attempts to circumvent these provisions — whether through resignation schemes or reinterpretations — would be a direct assault on the rule of law and the intent of the Founders.
I urge you to:
1. Publicly affirm your commitment to upholding the 22nd and 12th Amendments.
2. Support legislation or resolutions that clarify and reinforce these constitutional limits.
3. Oppose any efforts — legislative or procedural — that would enable a third term or vice-presidential candidacy for Mr. Trump.
Our democracy depends on the integrity of its institutions and the willingness of elected officials to defend them. I hope you will stand firm in protecting the Constitution and ensuring that no individual is allowed to undermine its principles.
Sincerely,
