Launch a formal investigation into Stephen Miller's reported role in directing the June 18 DOJ Office of Legal Counsel memo that authorizes states to institutionalize people with disabilities and discard decades of Supreme Court precedent. Multiple sources briefed on the situation say Miller personally drove this memo after growing frustrated that DOJ's Civil Rights Division was still enforcing Olmstead v. L.C. settlements. That is a White House political operative overriding federal civil rights law. That is illegal, unconstitutional, and cruel — and it meets the standard for abuse of power and high crimes and misdemeanors under Article 2, Section 4.
The 1999 Olmstead decision is settled law. This memo cites no evidence that community-based integration caused rising homelessness — because none exists. It was shaped by the Cicero Institute, a think tank with direct administration ties that openly opposes community care requirements. The people who will be locked in institutions because of this memo are among the most vulnerable in this country.
Congress must use its full oversight and impeachment authority now. Everyone involved in directing, drafting, or authorizing this memo must be investigated, impeached, convicted, removed from office, and prosecuted. Miller. Dhillon. Every official who participated in this lawless, cruel abuse of power. The constitutional tools exist. The evidence is on the record. Use them.
