Stop DOGE'S unauthorized access to our private information
To: Rep. Bacon, Sen. Fischer, Sen. Ricketts
From: A constituent in Omaha, NE
May 19
I received a response from Ricketts' office to my concerns about cutting important staff from NWS & affecting the accuracy of current weather reports, also highlighting how our Nebraska farmers need accurate information especially during early season. In response, I was told Ricketts supports DOGE's actions. That brings up another point. In supporting DOGE, do you also support the infiltration of our private information? It has been brought to my attention that Elon Musk and his associates, under the guise of a directive of the Department of Government Efficiency (DOGE) an IT office in the White House, have acquired access to Treasury Department Records in Systems of Records as defined in the Act. As an individual covered by the Act, I believe that there may be records about me in these Treasury Department systems, and I am concerned for the following reasons: Elon Musk is not an elected official. Even if Musk were an elected official, the System of Records Notices (SORNs) governing the Treasury Department Privacy Act systems do not allow for disclosure to Musk and his associates per the Routine Uses. Disclosure of personally identifiable information (PII) and sensitive personally identifiable information (SPII) to Musk and his associates would be an unauthorized disclosure and therefore breach of information. It has still not been answered which Privacy Act records Musk and his associates have unlawfully accessed. It has not been revealed to the public what unauthorized disclosures were made. Further access should be stopped & any files acquired by Musk and his associates ought to be returned and/or permanently destroyed, AND seek criminal penalties against Musk and his associates for violations of the Act. As your constituent, I am writing to ask you to ensure the government is protecting our privacy by demanding a stop to DOGE's unauthorized access to our most personal information. DOGE's access to databases at Treasury, Health and Human Services, and other agencies raises serious concerns about their compliance with legal requirements that ensure executive agencies are responsible stewards of our data. I am also concerned about the Trump administration’s flouting of long-standing legal requirements and how this could break down the checks and balances that protect our rights. Abuse of data and governmental procedures opens the door for wider abuses, including unconstitutional impoundment of funds, dismantling programs that help everyday Americans, corrupt use of sensitive confidential information for personal gain, and mass government surveillance. I urge you to conduct immediate oversight into DOGE’s actions and fight back against these intrusive privacy invasions which have occurred without consideration of the longstanding privacy safeguards mandated by the Privacy Act of 1974, 5 U.S.C. § 552a. the Internal Revenue Code, and other laws. Please write to tell me what you’re doing about this.
