Vote no on HR9109, the Stop ANTIFA Act. This bill would make the United States government do something it has deliberately never done — maintain a formal list of domestic terrorist organizations. That's not an oversight in our legal history. It's a constitutional guardrail, and HR9109 tears it out. "Antifa" has no membership rolls, no headquarters, no leadership, no bank accounts. It cannot be designated because it does not exist as an entity. The Brennan Center has noted that branding a movement rather than an organization gives federal agencies a vague, sweeping mandate to investigate and disrupt — anyone. Every act of violence this bill targets is already a crime. The bill adds only a label. What that label unlocks is the financial investigation provision, which points federal investigators at donors and nonprofits "associated with" an undefined term. That is a surveillance tool aimed at dissent, not crime. The FBI ran that playbook under COINTELPRO, and it took decades of reform to undo the damage. NAACP v. Alabama established that freedom of association is protected precisely because forced exposure of members chills speech for everyone. HR9109 revives exactly that threat.
