Due process is not optional

To: Rep. Van Duyne, Sen. Cruz, Sen. Cornyn

From: A constituent in Dallas, TX

May 2

I remain extremely concerned about this Republican administration’s defiance of a Supreme Court order in the case of Kilmar Abrego Garcia and failure to afford Mr. Abrego Garcia due process. Without due process, we have no way to know someone’s immigration status. Without due process, we have no way to ascertain someone’s guilt or innocence. By denying anyone due process, this administration is flaunting the Constitution, the Bill of Rights, and the rule of law. This Republican administration has thumbed its nose at the Supreme Court and its unanimous ruling in favor of due process. Congress, by not supporting the Supreme Court’s decision and defending the Constitution, is complicit in the administration’s illegal acts. With the executive branch acting unilaterally, with no checks or balances to its whims, Congress and the Supreme Court both are now subservient to the executive. This was our Founders’ worst fear. The United States cannot be allowed to become a dictatorship. Your duty is to defend the Constitution. Will you check the administration’s power? Or will you continue to abrogate your authority? Congress must act. Our nation must not slide into an authoritarian state.
