Demand Independent FBI Investigation of All ICE Shootings

To: Sen. Schiff, Sen. Padilla, Rep. Chu

July 21

The FBI must continue investigating all shootings involving ICE agents. Allowing Homeland Security Investigations — an arm of ICE itself — to investigate its own agents' use of deadly force is not accountability. It's a cover-up with a badge. The New York Times reported that FBI managers received written notice the bureau would no longer handle these cases, a change that followed two fatal ICE shootings in Texas and Maine within two weeks. The Justice Department denied it, but the contradiction between that denial and what FBI managers were told in writing demands congressional scrutiny. Past FBI investigations into assaults on DHS agents have produced evidence implicating those same agents in violent encounters. That's exactly why independent oversight matters, and exactly why removing it is dangerous. With 52 deaths in ICE custody in the first 500 days of this administration — a rate that has exceeded the worst pre-2025 month five times over — there is no credible argument that internal oversight is sufficient. Demand a full accounting of what the FBI was instructed to do, and make clear that no federal agency gets to investigate itself when lives are on the line.
