I am writing to urge immediate action to protect Americans from warrantless digital surveillance. Recent updates involving TikTok highlight how social media apps are increasingly collecting and sharing sensitive personal data in ways that risk turning the United States into a de facto police state.
This is time-sensitive. Delaying action puts people at risk now—especially vulnerable populations.
Congress must act to explicitly protect sensitive information, including:
• Sexual orientation and gender identity
• Immigration or citizenship status
• Financial data
• Precise location data
Unrestricted collection or sharing of this information increases the risk of harassment, targeting, detention, and violence against already vulnerable communities. No app should be allowed to collect or transmit this data unless it is strictly necessary—and never without due process.
I urge Congress to pass legislation that includes two immediate, non-negotiable requirements:
1) No Warrantless Government Access
Sensitive personal data must never be shared with any government entity—federal, state, local, or foreign—without a judicial warrant based on probable cause.
2) Clear, Easy Opt-Out for ALL Apps
Every app must provide a clear, simple, one-tap option to decline each category of data sharing. Declining must be as easy as accepting, with no hidden menus, dark patterns, or penalties for opting out.
To ensure compliance, violations should carry meaningful penalties of $1,000–$5,000 per infraction per affected user, along with mandatory deletion of unlawfully collected data.
This is not a partisan issue. It is about preventing abuse of power, protecting civil liberties, and keeping people safe. This cannot wait. The longer Congress delays, the greater the harm.
Please act now to ensure the United States remains a nation governed by the rule of law—not mass digital surveillance.
