I am writing again concerning the rule of law in our country, and the Constitutionally-guaranteed right to due process, specifically regarding the case of Kilmar Abrego Garcia.
If Mr. Abrego Garcia broke the law, the Constitution requires we charge him, then prove he broke the law. It forbids us from snatching him off the street, sending him to a foreign concentration camp, then alleging he broke the law.
In the words of Sir William Blackstone, "It is better 100 guilty persons should escape than that one innocent person should suffer.”
The Supreme Court has agreed, both in its unanimous decision last week regarding Mr. Abrego Garcia and in the more recent 7-2 order to stop sending Venezuelans to Venezuela without due process.
This Republican administration is bypassing Congress and thumbing its nose at the Supreme Court, expressing a deep contempt for the Constitution and American rule of law.
You, as a member of Congress, have the power to right this wrong. You have the power to defend the Constitution and the American legal system based on it. Mr. Abrego Garcia must be returned to the United States so his innocence or guilt can be proven.
My wife and I again urge you to reclaim your authority as a member of the legislative branch of government and fight for the Constitution in the face of these grave threats to it from the executive branch.
