The Equal Rights Amendment to the U.S. Constitution, which states "Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex," has met all the requirements for ratification outlined in Article V. After being approved by Congress in the 1970s, it has now been ratified by 38 states, exceeding the three-fourths threshold mandated by the Constitution. Despite this clear constitutional validity, the Archivist of the United States has declined to certify and publish the amendment as the 28th Amendment to the Constitution. This unprecedented failure to recognize a properly ratified amendment undermines a core principle of equality and continuing denial will only prolong an unacceptable state of affairs. Women's equality should be enshrined in our nation's founding document without further delay. Immediate action is needed to confirm the Equal Rights Amendment as part of the supreme law of the land in accordance with the provisions laid out in the Constitution itself. Prolonging this injustice serves no legitimate purpose and tarnishes America's commitment to equality under the law.
