Oppose NORRA of 2025, preserve judicial authority and oversight
To: Sen. Padilla, Sen. Schiff
From: A constituent in Mountain View, CA
April 18
The proposed NORRA of 2025 bill seeks to severely restrict the ability of federal district courts to issue injunctions that would apply more broadly, with limited exceptions. This represents a significant curtailment of the judiciary's authority and ability to provide relief in cases challenging executive branch actions impacting multiple states or the general public. I urge strong opposition to this legislation as it upends the vital system of checks and balances by hamstringing the courts. It undermines due process and the rule of law by preventing nationwide injunctions that can temporarily halt harmful policies until they undergo full judicial review. Instead of preemptively constraining the courts' remedial powers, we should preserve their ability to fully consider the merits and equities of each case in determining appropriate relief. Maintaining this judicial discretion is essential for upholding constitutional rights and safeguarding against irreparable harm from unlawful government conduct.
