Today I turn to the federal bench once more and write to urge you to Vote NO on Kasdin Mitchell's nomination to the federal bench. Kasdin’s record makes it clear that she would bring a hard ideological agenda to a lifetime appointment — and that should disqualify her. Rather than uphold the law and civil rights, she will be an ally to fringe-ist and hard right lunatics. Her legal pedigree is alarming: Mitchell clerked for Clarence Thomas, then built a career advancing far-right legal causes. She co-authored a white paper for the Washington Legal Foundation pushing to eliminate Chevron deference — a position the Supreme Court ultimately adopted in Loper Bright. She was a 2017 John Marshall Fellow at the Claremont Institute, a think tank whose alumni include John Eastman, who worked to overturn the 2020 election, and Russell Vought, the chief architect of Project 2025. That is disqualifying. She also wrote letters of support for a slate of controversial Trump judicial nominees. This is not a mainstream conservative lawyer — this is someone embedded in a coordinated effort to reshape the federal judiciary along extremist lines. She ought to be disbarred, not given a lifetime post. Her legal work follows the same pattern. She argued to expand corporate First Amendment rights while limiting individual speech protections in cases involving Meta and NetChoice. Federal judges must be independent arbiters, not advocates for the ideological network that produced them. Expose her background and oppose this nomination. Thank you.
