It actively chills free speech and freedom of association. The threat has only grown worse now that officials like Stephen Miller want to deploy AI to supercharge FISA surveillance, turning this into a tool for mass monitoring. Two specific loopholes must be closed before any reauthorization: the Backdoor Search Loophole and the Data Broker Loophole. Without these fixes, Section 702 remains a weapon against civil liberties rather than a legitimate counterterrorism tool.
