I am writing to formally describe the serious misconduct and negligence committed by Attorney **Rosemary Rubin** in her handling of my grandfather’s estate and personal affairs. Our family was forced to terminate her services after discovering numerous irregularities, questionable transactions, and unethical decisions that caused financial harm and emotional distress to my elderly grandfather and his heirs. Attorney Rubin was entrusted with managing my grandfather’s estate, financial matters, and long-term care planning. During her tenure, he was placed in a very expensive nursing home in Massillon, Ohio. To cover the cost of that facility, Attorney Rubin orchestrated the sale of nearly all his assets, including his family home, claiming that it was necessary to satisfy the facility’s high medical expenses. This was done without properly considering less costly and equally safe alternatives. It became apparent that Ms. Rubin acted with disregard for her fiduciary duty — the legal and ethical obligation to protect the best interests of her client, especially one who was elderly and vulnerable. The misconduct was discovered when **Ms. Anne Polen**, a family member who reviewed the estate and financial documents, identified several inconsistencies and potential acts of fraud. Upon close examination, she realized that the family home, which was explicitly intended to be inherited by the oldest son, was being wrongfully sold under Ms. Rubin’s supervision. Ms. Polen immediately questioned these actions, noting that they contradicted both the grandfather’s written and verbal intentions. Furthermore, the legal paperwork lacked full transparency, suggesting possible concealment of information and misrepresentation of financial details. Under Ohio law, attorneys are bound by strict ethical rules established by the **Ohio Rules of Professional Conduct**, particularly those addressing **competence (Rule 1.1)**, **diligence (Rule 1.3)**, **communication (Rule 1.4)**, and **conflicts of interest (Rule 1.7)**. Ms. Rubin’s actions appear to have violated several of these rules. Her failure to act in the client’s best interest, her mismanagement of estate assets, and her possible involvement in coercing an elderly man to sell his property all raise serious concerns of **legal malpractice** and **elder exploitation**. For these reasons, our family terminated Attorney Rubin’s representation and filed formal complaints. Her actions were not only unethical but deeply harmful. We believe she has demonstrated a pattern of disregard for both professional duty and human decency. In our view, she is unfit to represent vulnerable clients in the State of Ohio and should be held accountable for her misconduct.
