Regulate AI Deepfakes Used for Harassment and Cyberstalking
To: Pres. Trump
From: A constituent in Metairie, LA
September 13
Pass legislation that explicitly criminalizes the use of AI-generated deepfakes for harassment and cyberstalking. Right now, bad actors can clone a private citizen's face or voice using tools that require nothing more than a smartphone clip and a free account, then weaponize that synthetic media to stalk, intimidate, and destroy reputations. The law has not kept up.
The technology is not theoretical. Voice cloning requires as little as three seconds of audio. Face-swapping runs on a consumer laptop. The same tools that cost one Hong Kong company $25 million in a single fraud call are being turned on private individuals with no recourse. A Baltimore principal had racist statements fabricated in his voice and distributed to his community. These are not edge cases — they are the predictable result of powerful tools with no meaningful legal guardrails against personal targeting.
Federal law needs to close this gap directly: criminalize the creation and distribution of non-consensual synthetic media designed to harass, stalk, or intimidate a specific person. The TAKE IT DOWN Act addressed non-consensual intimate imagery, which is a start, but harassment and cyberstalking through deepfakes extends far beyond that category. Victims need a clear legal remedy, and perpetrators need to know there are real consequences.
