Thank you for not bringing the SAVE Act to a vote. This bill has been stalled for nearly 300 days, and that's exactly what should happen to legislation that undermines both our Constitution and the right to vote. The SAVE Act violates the basic structure of our federalist system. States have exclusive authority to set voter qualifications for federal elections. Congress has the power to regulate election procedures, not to impose citizenship documentation requirements that function as voter qualifications. The Supreme Court made this clear in Arizona v. Inter Tribal Council. The practical effects of this bill would be devastating. An estimated 146 million Americans don't have passports. About 69 million women don't have documents matching their current legal names because they changed their surnames after marriage. Over 21 million Americans lack ready access to the required documents. The bill would eliminate online and mail registration, which 15 million Americans used in 2022, forcing everyone to appear in person with original documents for any registration update. The bill criminalizes election officials, threatening them with up to five years in prison for registering eligible citizens who lack the exact documents specified. This creates a system where officials will reject legitimate voters rather than risk prosecution. State audits of the 2024 election found noncitizen voting is extraordinarily rare. Michigan found 16 cases out of 5.7 million ballots. Iowa found 35 cases out of 1.6 million votes. The Center for Election Innovation & Research concluded that noncitizens are not a threat to our election system and found no coordinated effort to register noncitizens in any state. The SAVE Act addresses a problem that doesn't exist while creating massive barriers for millions of eligible American citizens. Please continue to oppose this bill and any similar legislation that would restrict the constitutional right to vote.
