Oppose Section 24220 Kill Switch Mandate in New Vehicles

To: Rep. Elfreth, Sen. Van Hollen, Sen. Alsobrooks

I need you to oppose Section 24220 of the 2021 Bipartisan Infrastructure Law, which mandates kill switch technology in all new cars starting in 2027. This provision forces manufacturers to install AI systems that can stop vehicles if they determine a driver is impaired. As Representative Massie said, "Your dashboard should not be judge, jury, and executioner." Even at 99.9% accuracy, this system would produce millions of false positives annually, locking sober drivers out of their vehicles. NHTSA already missed its 2024 deadline because the technology isn't ready. Ford's recently published patent reveals the real agenda: biometric systems that scan faces and fingerprints, check them against law enforcement databases in real time, and share results with police. This isn't about drunk driving. It's about surveillance. This mandate strips Americans of vehicle control and privacy. The technology is hackable, adds unknown costs to car prices, and could cause accidents or prevent emergency hospital trips. When Representative Massie introduced an amendment to defund this mandate in 2026, it failed 164-268, but that doesn't mean this fight is over. Vote to repeal Section 24220 and block any funding for this mandate. Americans deserve vehicles they control, not ones that control them.
