Subsidizing Lawlessness: Reject the Fiscally Reckless DHS Rider
To: Rep. Beatty, Sen. Husted, Sen. Moreno

I am writing to demand that you vote NO on the $72 billion DHS reconciliation package. This bill is a dual assault on the American taxpayer: it funnels $1 billion into a private vanity ballroom project under the fraudulent guise of "security," while providing a blank check to ICE and CBP—agencies currently operating under a documented cloud of constitutional non-compliance. The Rule of Law requires fiscal honesty and constitutional fidelity. This bill fails both standards: - The $1 Billion Vanity Project Bailout: This legislation directs $1 billion to the Secret Service for "security adjustments" related to the White House East Wing ballroom. This is a transparent bait-and-switch. This project—a 90,000-square-foot luxury gala space—was promised to the public as a privately funded endeavor, yet this bill forces taxpayers to pay 400% of the project's original $250 million construction estimate. Furthermore, this project was initiated in a legally deficient manner; it is currently the subject of federal litigation where a district court judge has already ruled that the administration overstepped its authority by bypassing Congressional approval. Using the reconciliation process to fund a project currently being held up in court for its own illegality is a fiscally reckless abuse of Article I power. - Funding 4th Amendment Violations: Internal evidence confirms that ICE has adopted a policy of using administrative warrants to authorize forced entry into private residences. By funding an agency that intentionally bypasses the judicial warrant requirement mandated by the 4th Amendment, you are subsidizing executive lawlessness and abdicating your oversight duty. - Defying Judicial Rulings on Due Process: On April 28, 2026, the U.S. Court of Appeals for the Second Circuit ruled that the administration’s mandatory detention policies violate the law. Doubling down on funding for mass detention without bond hearings ignores a direct judicial rebuke and guarantees that more taxpayer dollars will be wasted on litigation the government is legally certain to lose. - Failure of Institutional Competency: Whistleblower testimony from former instructors confirms that "expedited training programs" for new federal agents are deficient and broken. Prioritizing hiring volume over professional standards creates massive legal liabilities and endangers the civil rights of everyone within U.S. jurisdiction. I urge you to reject this reconciliation package. Demand that all DHS funding be subject to Regular Order, where it can be properly audited and held to constitutional standards. Your vote on this bill will serve as a direct indicator of whether you prioritize the Rule of Law or executive vanity and malfeasance.
