Despite emerging consensus in the AI field that unregulated development poses serious risks, both the current administration and Speaker Johnson have nonsensically asserted that this technology should remain above the law and without legislative guardrails in the United States. Congress has a duty to regulate new and existing technologies that impact the lives of Americans. Moreover, failure to act will not prevent other countries and international bodies from implementing regulations—-it will only demonstrate our nation’s inability to comprehend rapidly evolving technologies and behave responsibly as a peer nation. Leading AI firms have already publicly acknowledged they cannot self-regulate or control their existing models. Should Congress fail to regulate these technologies, our government will share liability with them for harms they may cause. Inaction is not a viable option.
