I am writing again to urge you to demand Kilmar Abrego Garcia’s release from the CECOT prison in El Salvador, and to defend the due process guaranteed by the Constitution’s Fifth Amendment.
As a person on United States soil, Mr. Abrego Garcia was Constitutionally-guaranteed the right to present his case to an immigration judge. That right to due process is the foundation of our legal system. Lack of due process for one person effectively deprives all of us of that right.
If we accept non-citizens have no right to due process, then we must also accept citizens have no right to due process. All the government has to do is claim someone is not a citizen—without due process, that person would have no chance to prove they ARE a citizen.
This Republican administration refuses to be bound by the Constitution. If the right to due process is erased, which right will be erased next? America’s rule of law is being gutted real time.
More concerning, does ICE being able to waive the Fifth Amendment with impunity extend to other law enforcement agencies? Will deputies and police officers, on a whim, also be able to make people disappear to El Salvador gulags?
My wife and I ask you to honor the oath you took to defend the Constitution. Bring Mr. Abrego Garcia back and uphold the rights all people are guaranteed in the Constitution.
