Our State’s Elections Are Under Federal Attack — Act Now

To: Gov. Spanberger

From: A constituent in Lovettsville, VA

March 31

This past Saturday, millions of Americans took to the streets across all 50 states in one of the largest protest movements in modern history, demanding the protection of democracy. Three days later, on March 31, 2026, President Trump responded by signing an executive order that represents the most direct federal assault on state election authority in generations. The order directs the Department of Homeland Security and the Social Security Administration to compile a federal list of voters deemed eligible to vote in each state. It then instructs the U.S. Postal Service to send absentee ballots ONLY to those on that federally approved list. States that refuse to comply face the loss of federal funding. This is not election security. This is federal control of who gets to vote. The Constitution is unambiguous: states run their own elections. The president has no constitutional authority to determine who appears on your state’s voter rolls. Three separate federal courts have already blocked earlier Trump election executive orders on exactly these grounds. Election law experts are calling this order unconstitutional on its face and expect it to be challenged immediately. But here is the danger that cannot wait for the courts: No one knows what happens to an eligible American citizen who is accidentally or improperly left off this federally compiled list. Military voters, college students, frequent travelers, elderly citizens, rural residents — the very people who depend most on mail voting — could be silently disenfranchised before they even know it. The administration’s stated justification is mail voting fraud — which a 2025 Brookings Institution study found occurs in 0.000043% of ballots. Roughly four cases per 10 million votes. The President himself voted by mail last week. This is voter suppression with a federal price tag attached. We urge you to join the legal challenge against this executive order immediately, communicate clearly to your constituents that their voting rights remain protected by your state, and refuse to comply with any federal mandate that contradicts your state’s constitutional authority over elections. The midterms are coming. Your constituents’ right to vote must be protected.
