Defend due process for Kilmar Abrego Garcia

To: Sen. Cruz, Sen. Cornyn, Rep. Van Duyne

From: A constituent in Dallas, TX

April 24

I am writing again about this Republican administration defying the Constitution in rendering Kilmar Abrego Garcia, without due process, to a foreign prison where the U.S. has no legal jurisdiction. Mr. Abrego Garcia is being held without having any charges filed against him. El Salvador’s brutal dictator, Nayib Bukele, has vowed he will never return any person sent to him from America. This flies in the face of the due process provision in the Fifth Amendment. It is also anathema to the bedrock of American criminal law—the accused is assumed innocent until proven guilty. Mr. Abrego Garcia’s right to due process is not optional. If he is guilty as alleged, bring him back, charge him, prove he’s an MS-13 member, then lawfully jail him. If he is not guilty, free him. This Republican administration is still defying the Supreme Court regarding returning Mr. Abrego Garcia. Congress is sitting idly by while the administration shreds the Constitution. Does the federal government now have only one branch? Congress must act to ensure this administration follows the Supreme Court’s 9-0 decision in this matter. My wife and I again strongly urge you to fulfil your oath to protect the Constitution. Compel this administration to bring Kilmar Abrego Garcia back to defend himself in court, as required by law.
