I am writing to express my deep concern regarding a recent Executive Order, Ensuring Accountability for All Agencies, issued by the President on February 2025. Specifically, Section 7 of the order asserts that the President and the Attorney General have the final authority on the interpretation of law within the executive branch. This appears to be a significant overreach of executive power and contradicts the separation of powers outlined in our Constitution.
As you know, the Constitution vests the interpretation of laws in the Judicial Branch, while the Executive Branch is tasked with enforcing those laws. By attempting to centralize legal interpretation within the presidency, this order undermines judicial authority and disrupts the balance of power fundamental to our system of government.
The relevant section of the Executive Order states:
"The President and the Attorney General, subject to the President’s supervision and control, shall provide authoritative interpretations of law for the executive branch. The President and the Attorney General’s opinions on questions of law are controlling on all employees in the conduct of their official duties."
This language effectively grants the executive unilateral control over legal interpretation, restricting agencies and officials from presenting independent legal assessments—even in litigation or regulatory matters—unless they align with the President’s views. This sets a dangerous precedent that erodes checks and balances and diminishes the role of the judiciary.
I urge you to take a stand against this executive overreach and advocate for the preservation of our constitutional system. Please let me know what actions you plan to take in response to this issue. I appreciate your time and your commitment to upholding the integrity of our government.
Thank you for your attention to this critical matter. I look forward to your response.
