Subject: Request to Initiate Action Against Justice Todd Eddins for Defiance of U.S. Supreme Court Precedent on the Second Amendment Dear Senator/Representative and Governor Green I am writing as a concerned constituent from Honolulu to urge you and your colleagues in the Hawaii State Legislature to take action regarding Hawaii Supreme Court Justice Todd Eddins. Specifically, I ask that you support efforts to impeach or otherwise remove him from the bench due to his open defiance of U.S. Supreme Court rulings on the Second Amendment, which is the supreme law of the land under the U.S. Constitution. In State v. Wilson (2024), Justice Eddins authored a unanimous opinion that directly challenged and sought to undermine the U.S. Supreme Court’s decisions in New York State Rifle & Pistol Association v. Bruen (2022) and related cases. Rather than faithfully applying the constitutional framework established by the nation’s highest court, Justice Eddins criticized Bruen for “snubb[ing] federalism principles,” questioned its historical analysis, and prioritized Hawaii’s “spirit of Aloha” over the individual right to keep and bear arms. He asserted that there is no state constitutional right to carry firearms in public and defended broad government restrictions, even while acknowledging the U.S. Supreme Court’s contrary interpretation. This is not mere disagreement — it represents a deliberate refusal to uphold the overriding authority of the U.S. Constitution and binding Supreme Court precedent. The Second Amendment protects a fundamental individual right to self-defense that limits government power, a principle reaffirmed multiple times by the U.S. Supreme Court. State judges take an oath to support the U.S. Constitution, and repeated defiance of that oath erodes the rule of law and the separation of powers. The Hawaii Constitution provides for the impeachment and removal of appointive officers, including judges, for appropriate causes. I respectfully urge you to: • Introduce or co-sponsor articles of impeachment against Justice Eddins. • Support legislation or resolutions reinforcing judicial adherence to U.S. Supreme Court precedent on constitutional rights. • Work with the Judicial Selection Commission and other bodies to address this issue and restore public confidence in an impartial judiciary. As a resident of Hawaii committed to constitutional principles, I believe no judge should be above the law or free to substitute personal or cultural preferences for the supreme law of the land. I ask for your leadership in defending the rights of law-abiding citizens and the proper limits on government authority. Thank you for your time and service.
