The plain reading of the 14th Amendment's Section 3 prohibits any person who previously took an oath to uphold the Constitution from holding federal or state office if they engaged in insurrection or rebellion against the United States. As President, Donald Trump took an oath to faithfully execute the office and preserve, protect and defend the Constitution. However, he betrayed that oath by fomenting the January 6th attack on the Capitol aimed at overturning the 2020 election results based on false claims of widespread voter fraud. Given this role in inciting an insurrection against American democracy and attempt to overturn legitimate election results, there are strong arguments that he is constitutionally ineligible to run for president again without Congress voting by a two-thirds majority in both chambers to remove this disqualification. Enforcing this provision maintains the integrity of democratic institutions and the sanctity of the oath of office.
