Simply put, there is no place for secret police in the United States of America, yet that is exactly what ICE has become.
Masked plainclothes officers pulling people of the streets into unmarked vehicles, refusing to identify themselves, shipping arrested suspects off to detention facilities across the country; these are not hallmarks of a lawful and transparent branch of law enforcement.
Unfortunately, these behaviors are not limited to ICE; city, state, and other federal agencies have also engaged in the same behaviors during the 2020 protests and beyond.
Therefore, I propose you pass legislation that accomplishes the following:
1. Require all city, state, and federal officers to wear uniforms and ID at all times when carrying out law enforcement duties, unless specifically authorized by a judge to do undercover work.
2. Any arrest or detention of a US person while concealing their identity, agency affiliation, or ID shall be considered an illegal detention and impersonating a law enforcement official.
3. Any charges brought against a US person by any law enforcement officer who conceals their identity without authorization shall be dropped, and any evidence from their detention considered inadmissible in court.
4. Clearly states that US persons have the right to self-defense against an officer of the law, if said officer did not present identification, was not in uniform, or was making other efforts to conceal their identity at the time of their detention.
These are not anti-police or anti-government proposals. Authoritarian regimes use masked and anonymous police to intimiate and spread fear; to create the impression that they are everywhere and can work without consequence. Free societies have law enforcement that wears uniforms and has their identities known to the public, so that they are forced to operate with transparency and accountabiltiy
