I am writing again to demand the release of Kilmar Abrego Garcia from El Salvador’s CECOT prison.
Mr. Abrego Garcia was not given due process as Constitution requires.
He has no criminal record in the United States or El Salvador.
He was living and working legally after immigration judge granted him protected status that explicitly prohibited his return to El Salvador, where gangs had threatened to kill him.
The Supreme Court ruled 9-0 to free Mr. Abrego Garcia. This Republican administration is ignoring that ruling, just as it is ignoring the Constitution.
Either the courts get to decide who is a “violent criminal” or “gang member,” or Donald Trump gets to decide. That choice determines whether we are a Republic governed by laws, or an autocracy living under a dictator.
As soon as we abandon the idea everyone is equal under the law and have the right to due process, we’ve lost democracy.
This is a five-alarm fire for democracy.
My wife and I implore you to use your Congressional authority to demand the President obeys the Supreme Court to ensure our Republic stands and our democracy thrives. Restore accountability to the executive branch of our government.
