Restore Congressional Authority Over Tariff Decisions

To: Rep. Messmer, Sen. Young, Sen. Banks

From: A constituent in Mount Vernon, IN

April 8

I am writing as a concerned constituent to urge you to take action to reassert Congress’s constitutional authority over trade and tariff decisions. Article I, Section 8 of the U.S. Constitution clearly assigns the power to regulate commerce—including the imposition of tariffs—to Congress. However, in recent years, we’ve seen a troubling trend in which this power has been delegated to the executive branch, enabling unilateral decisions that can disrupt markets, strain international relationships, and hurt American workers, businesses, and consumers. Tariff decisions should not be wielded as political tools or made without full transparency and debate. Restoring Congressional authority would ensure: •Proper checks and balances between the legislative and executive branches; •Deliberative and representative decision-making that considers the full economic impact on constituents; •Greater accountability in how trade policy is formed and enforced. I respectfully ask that you support or introduce legislation that limits the executive’s ability to impose tariffs without Congressional approval, especially under broad interpretations of national security exemptions. Doing so will help restore integrity to the trade policy process and uphold the constitutional role of Congress. Thank you for your attention to this important issue. I hope you will stand up for the proper balance of powers and support trade policies that are fair, thoughtful, and accountable.
