An Open Letter
To: Pres. Trump
From: A constituent in Los Angeles, CA
January 8
I am writing to condemn the accelerating pattern of violence, unlawful detention, and constitutional violations by ICE and DHS enforcement units. The abuses are documented and ongoing — and Congress has a duty to stop them. Recent reporting shows a federal enforcement culture operating outside constitutional limits. Examples include: the Jan. 7, 2026 fatal ICE shooting in Minneapolis (Washington Post); the deployment of 2,000 federal immigration agents into Minnesota criticized as militarized intimidation (AP News); federal court injunctions blocking warrantless ICE arrests in Colorado (ACLU-CO/Federal District Court); and lawsuits alleging unlawful arrest and detention without warrants or counsel (ACLU-SoCal). These are not isolated events. They reflect systemic disregard for the First, Second, Fourth, and Fifth Amendments due process, and habeas corpus. There are also credible concerns over unlawful detention and deportation actions involving U.S. citizens — something the law does not permit under any circumstance. Warrantless stops, harassment, mass raids, coerced searches and seizures, denial of counsel, and opaque detention practices resemble historic federal overreach we once swore never to repeat. The Constitution is not optional. Congress must enforce it. I call on you to act now: 1. Hold aggressive oversight hearings with subpoena power. 2. End qualified immunity for federal agents who commit constitutional violations. 3. Pass and strengthen pending federal legislation, including: • ICE Security Reform Act of 2025 (H.R. 673) • Visible Identification Standards for Immigration-Based Law Enforcement (VISIBLE) Act • Stop ICE from Kidnapping U.S. Citizens Act (H.R. 4456) • Accountability for Federal Law Enforcement Act 4. Mandate independent civilian oversight, body-cam transparency, and full public reporting. 5. Prohibit warrantless arrests, mass raids, and home entries without judicial authorization. 6. Create civil remedies for victims. I also condemn the political ecosystem — including Donald Trump, his cabinet allies, financiers, media surrogates, and the MAGA movement — that encourages extrajudicial enforcement and treats immigrant communities as political props. Authoritarian policing is not “law and order.” It is the opposite. Democratic lawmakers must lead with clarity and courage. Publicly denounce these abuses. Force votes. Protect the Constitution in practice — not just in speeches.
