The clear language of the 14th Amendment disqualifies Donald Trump from holding federal office due to his role in the January 6th insurrection attempt to overturn the 2020 election results. Applying Section 3 of this amendment is a necessary step to uphold the rule of law and protect American democracy. While the decision may provoke backlash from Trump's supporters, constitutional principles must take precedence over any threats or political fallout. The peaceful transfer of power is a bedrock tenet that cannot be violated, no matter how popular or influential the candidate. Permitting Trump to hold office again despite his actions would effectively nullify the 14th Amendment and embolden future insurrectionists. To preserve our democratic system of government for future generations, Trump must be held accountable and disqualified from holding office again without an act of Congress to pardon him. If he is to hold office again, Congress must give him amnesty to do so, by default, he is disqualified. Difficult as this decision may be, it is vital to reaffirm that no person is above the law.
