I am writing to express my deep concern over the Trump administration’s ongoing and unconstitutional expansion of immigration enforcement that has repeatedly violated the rights of U.S. citizens and legal residents. Recent government oversight reports and press investigations show that under both the current and past Trump administrations, agencies like ICE and CBP have escalated practices that ignore due process protections guaranteed by the Fourth and Fifth Amendments of the U.S. Constitution. The U.S. Supreme Court has long held that all persons in the United States—regardless of citizenship status—are protected by these constitutional provisions. Yet the Department of Homeland Security (DHS), through ICE and CBP, has routinely arrested, detained, and in some cases even deported U.S. citizens based on flawed internal procedures and a lack of accountability. According to a 2021 Government Accountability Office (GAO) report, ICE arrested 674 potential U.S. citizens, detained 121, and deported 70 between 2015 and early 2020. These are not just statistics—they represent American lives wrongly disrupted, rights violated, and families torn apart. The same report highlights ICE’s internal failings, including inconsistent training, poor supervision, and flawed data management. Officers are not required to update citizenship status in ICE’s databases even after evidence confirms someone is a U.S. citizen. As a result, ICE cannot even determine how many Americans have been wrongly targeted under civil immigration laws that do not apply to citizens. The situation is likely worsening. Congress must demand that ICE and CBP: • Fully implement GAO recommendations, including updating and enforcing consistent citizenship verification protocols; • Establish systems to track and audit all enforcement actions involving U.S. citizens or legal residents; • Prohibit detainers and removals without verified, supervisory-confirmed documentation of non-citizenship; • Enshrine legal protections and guaranteed counsel for individuals detained under immigration law. Unchecked immigration enforcement must not override constitutional rights. The rights of U.S. citizens and all people within our borders must be respected, and agencies that violate them must be held accountable.
