No Section 702! No Warrantless Spying Loopholes.

I urge you to reject any extension or reauthorization of Section 702 of the Foreign Intelligence Surveillance Act unless it includes a real warrant requirement, closes the backdoor search loophole, and prevents the government from evading constitutional protections through data brokers. Section 702 is often described as a foreign-intelligence tool, but in practice it sweeps up Americans’ calls, texts, and emails when they communicate with people overseas. Once collected, federal agencies can search those communications without first getting a warrant. That is a dangerous backdoor around the Fourth Amendment. The abuses are not theoretical. Section 702 data has been used in improper searches involving protesters, members of Congress, a congressional chief of staff, a state court judge, U.S. government officials, journalists, political commentators, and 19,000 donors to a political campaign. No member of Congress should pretend this power will only be used carefully or neutrally. The current push to renew Section 702 without a warrant requirement would preserve the very loophole that has enabled these abuses. It would also leave Americans vulnerable to expanding surveillance systems at a time when government agencies are increasingly relying on data brokers, automated tools, and mass data analysis. Privacy is not a partisan issue. Lawmakers from both parties have raised alarms about warrantless searches of Americans’ communications. Congress should hold the line instead of handing any administration broad surveillance authority without meaningful safeguards. Vote NO on any Section 702 extension or reauthorization that lacks a warrant requirement. Vote NO on any bill that preserves warrantless backdoor searches. Support only reforms that require judicial approval before searching Americans’ communications and that close the data broker loophole. No more spying loopholes. No warrant, no search.
