I am writing to urge you to oppose the current tariff policies that courts have already ruled unlawful and to support legislation requiring direct refunds to consumers who have borne the cost of these unconstitutional measures.
Recent court rulings have found Trump's tariffs to be unlawful, yet American consumers continue to pay the price. Trade policy experts, including critics of Trade Representative Jamieson Greer's recent comments, have correctly identified tariffs as a regressive sales tax that disproportionately harms working families. When tariffs increase the cost of goods, everyday Americans pay more at the checkout counter while corporations pass these costs directly to consumers.
The constitutional concerns are significant. These tariffs were implemented without proper congressional authorization, violating the separation of powers that protects citizens from executive overreach. Courts have recognized this fundamental problem, but consumers have not been made whole for the unconstitutional taxes they paid.
I am specifically asking you to support legislation that would require direct refunds to individual consumers, not corporations. Companies have already collected these inflated prices from customers. Any refund mechanism must ensure that the money goes back into the pockets of the people who actually paid the higher costs, not to corporate balance sheets. This is a matter of basic fairness and constitutional accountability.
The economic impact on your constituents is real and measurable. Families are paying more for everyday necessities because of these unlawful tariffs. They deserve both relief from future unconstitutional trade policies and restitution for what they have already paid.
I urge you to take a clear stand against these tariffs, support their immediate removal, and champion legislation that puts refunds directly in the hands of consumers. Your constituents should not continue subsidizing unconstitutional policy while corporations benefit from the chaos.
