The ACLU rightly opposes H.R. 9495, which would hand unchecked power to the president to unilaterally impose criminal penalties relating to immigration without due process. This bill is a violation of constitutional principles and an unacceptable erosion of checks and balances. Congress must reject attempts by the executive branch to expand its authority beyond constitutional limits. Upholding democratic norms requires legislators to serve as a counterweight against presidential overreach that threatens civil liberties. Vote no on this dangerous legislation that undermines the foundations of a free society.
