Investigate DOJ's Threat to Block State Election Certification

To: Sen. Alsobrooks, Rep. Elfreth, Sen. Van Hollen

From: A verified voter in Arnold, MD

October 23

Investigate the Department of Justice's stated openness to blocking state election certification and pass every available protection for voters and election officials before November 2026. Attorney General Todd Blanche, when asked directly whether DOJ might try to prevent a state from certifying its results, refused to rule it out. The federal government has no legal authority over state certification. Full stop. Blanche's comments follow a pattern. In July, he declined to commit to keeping federal agents away from polling places. In September, DHS Secretary Markwayne Mullin left open the possibility of ICE arrests at the polls. A dozen senators have already warned Blanche, Mullin, and Defense Secretary Pete Hegseth that deploying federal agents at election sites is illegal under federal law. Those warnings have produced no firm commitments. State-level protections for voters and election certification processes must be strengthened now, before ballots are cast.
