Oppose Bathroom Criminalization Bills That Force Impossible Choices

To: Gov. Whitmer, Rep. Andrews, Sen. Nesbitt

From: A constituent in Stevensville, MI

March 17

Oppose any legislation that criminalizes transgender people for using bathrooms that match their gender identity. These bills don't protect anyone. They force transgender people into an impossible choice: face assault in a bathroom where they don't fit in, or risk felony charges for using the one where they do. Consider the reality for a transgender man with a beard. If he uses the men's room, he risks arrest if someone suspects he's trans. If he uses the women's room, he faces potential violence from people who see a man walking in. No one should have to choose between jail time and physical assault just to use a public restroom. These laws are unenforceable without invasive scrutiny of people's bodies. They apply to government buildings and private businesses, turning everyday activities into legal minefields. Some versions make repeat violations a felony with years of prison time. They solve no actual problem and instead criminalize people for existing in public spaces. Vote no on bathroom criminalization bills. Reject legislation that creates danger for transgender people no matter which door they choose.
