Modernizing California’s Operating System for an Age of Abundance

To: Gov. Newsom

From: A constituent in San Diego, CA

October 15, 2025

5 California has the imagination and wealth to lead the world, yet our institutions still run on a 19th-century operating system. Article XVI’s 1879 debt limits, written to stop railroad speculation, have hardened into barriers that block building. Rules that once protected taxpayers now prevent California from investing in its future. Reform stalls because Proposition 13 is seen as untouchable. But Article XVI and Prop 13 govern different things. Article XVI restricts borrowing; Prop 13 and Prop 218 restrict revenue. Together they force two supermajority elections for one project, producing delay, workarounds, and frustration. To prove abundance can work, government must build again, efficiently, locally, and accountably. Three coordinated reforms: Replace Article XVI with a new Public Finance, Investment, and Fiscal Responsibility article. Treat investment as a core duty, not an exception. Remove the two-thirds election for ordinary, fiscally prudent borrowing and use independent certification, public audits, and periodic review. Modernize or replace Prop 13 with a Land Value Tax that stabilizes homeowners while taxing speculation and under-used land, unlocking infill and helping solve the housing crisis. Reform Prop 218 to restore local fiscal autonomy and end ballot fatigue. These changes would align the constitution with our values: restore local fiscal power; require audits, life-cycle cost reporting, and anti-corruption enforcement; keep voter referendums for extraordinary spending; replace distrust with competence and transparency. This is not about taxing more but governing better. California can protect taxpayers while investing in housing, infrastructure, water, and climate resilience. This is a leadership moment. California can show that democracy still solves hard problems by proposing a system that works. Reagan said the nine scariest words are “I’m from the government and I’m here to help.” In a government of, by, and for the people, those words should be hopeful. Let’s make them true again.
