Support Accountability for Federal Rights Violations

To: Rep. Stemen, Sen. Roers, Gov. Armstrong, Rep. Brown

From: A constituent in Horace, ND

February 3

I am reaching out to request that you review CA Sen. Scott Wiener's bill -SB 747. This bill would would allow California residents to sue federal officials, including ICE agents, for constitutional rights violations. My ask is that you draft similar legislation here. I strongly believe this legislation addresses a critical gap in accountability that has resulted in tragic consequences for American citizens. The recent deaths of Renee Good and Alex Pretti, two U.S. citizens shot by federal agents in Minneapolis, demonstrate the urgent need for this reform of our legal code. Currently, victims and their families have no meaningful recourse when federal officials violate their constitutional rights. This near immunity creates a dangerous double standard where federal agents operate without the same accountability measures that apply to state and local law enforcement. Beyond protecting constitutional rights, this bill would actually strengthen public safety. When federal agents act without accountability, it undermines trust in all law enforcement and makes local police work more difficult. As we know, cooperation on difficult cases between Federal and local law enforcement is supposed to be a matter of course. Communities need to know that every officer, regardless of jurisdiction, can be held responsible for misconduct. This accountability framework does not prevent legitimate law enforcement operations but ensures they are conducted within constitutional boundaries. Creating a civil remedy for constitutional violations by federal officials is not about sanctuary policies or immigration enforcement debates. It is about fundamental fairness and the principle that no government agent should be above the law. Every resident, regardless of citizenship status, deserves protection from unconstitutional actions by those entrusted with authority. I ask you to support this legislation and help establish meaningful accountability for federal officials operating in our state. Our state has a responsibility to protect the constitutional rights of all residents, and this bill provides an essential tool to do so.
