Request for Texas Legislation to Stop Ticket Resale Price Gouging

To: Sen. Flores, Rep. Bucy

From: A constituent in Austin, TX

November 20

I am writing to ask you to consider legislation that protects Texans from unfair ticket resale practices. People across our state continue to struggle to access concerts, sports events, and other live entertainment because tickets are purchased in bulk by bots and professional scalpers, then resold at extreme markups. Many Texans never even have a fair chance to buy tickets at face value. Other states have already taken meaningful steps to protect consumers. Connecticut has laws that restrict how much above face value tickets can be resold and require clear disclosure of any service charges. This prevents resellers from hiding inflated markups and gives buyers transparency about what they are actually paying for. New York has addressed another part of the problem by criminalizing the use of ticket-buying bots. Their law makes it illegal to use automated software to bypass purchase limits and scoop up large numbers of tickets for resale. It also allows penalties against individuals and companies who use these tools to manipulate availability. These laws show that states can take action to curb price gouging, limit bot activity, and improve fairness for fans. Texas should consider adopting similar safeguards. Our state should protect consumers, not allow automated systems and bulk resellers to dominate the market. I respectfully ask the Texas Legislature to consider legislation that would: • Ban or cap the resale of tickets above face value • Prohibit the use of automated bots to purchase tickets • Require full transparency in ticket pricing and all added fees • Give Texans a fair chance to purchase tickets directly from primary sellers • Strengthen enforcement and penalties for companies or individuals who violate these rules These measures would help restore fairness in the ticket marketplace and make live events more accessible for people across Texas. Thank you for your time and for your service to our state. I hope you will consider legislation that protects Texans from ticket resale price gouging and modernizes our consumer protection laws.
