Kilmar Abrego Garcia still has not been returned to the United States for his day in court, despite the Supreme Court’s 9-0 ruling for his immediate return. That is illegal.
The President admitted, in an ABC interview, he could bring Mr. Abrego Garcia back with one phone call. He simply doesn’t want to.
Without due process we have no way to know Mr. Abrego Garcia’s guilt or innocence.
If this Republican administration can arbitrarily decide who deserves rights and who doesn’t, then no rights truly exist. They become privileges, granted or revoked at the whim of those in power.
This is not how a constitutional republic works. It is how authoritarian regimes operate.
Without due process, anyone—including US citizens—can be snatched off the street, with no chance to prove their innocence or immigration status.
That was John Quincy Adams’ argument before the Supreme Court when representing the Amistad defendants. The Court agreed.
Your job, your duty, is to defend due process as an integral part of our Constitution. You have the power to safeguard our democracy. Not doing so leaves Congress subservient to the executive branch.
My wife and I demand you and your fellow Congresspeople force the President to make that “one phone call” to bring Mr. Abrego Garcia back. Kilmar Abrego Garcia must be returned so he may face his accusers and prove his immigration status, as well as his guilt or innocence, as required by the Constitution.
