I am writing to you as a concerned citizen regarding the enforcement of Section 3 of the 14th Amendment to the United States Constitution, which addresses disqualification from holding office due to participation in insurrection or rebellion. This provision clearly states: "No person shall... hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof." As you are aware, this clause does not require a formal criminal conviction to disqualify an individual from office. Instead, it applies to those who have participated in or supported an insurrection, regardless of judicial findings. Legal scholars and recent court rulings have emphasized that this provision is self-executing and is grounded in the fundamental principle that officials who violate their constitutional oath should not serve in positions of public trust. The events surrounding January 6, 2021, including the attack on the U.S. Capitol, have raised legitimate concerns about the participation of some individuals in an insurrection against our government. It is critical for Congress and other relevant authorities to investigate these actions and enforce the constitutional safeguards that protect the integrity of our democracy. I urge you to take a firm stand in upholding the Constitution by ensuring that any individual who has engaged in insurrection or rebellion, or provided aid or comfort to such efforts, is held accountable under Section 3 of the 14th Amendment. As representatives of Arkansas, you have a duty to uphold the rule of law and preserve the principles upon which our nation was founded. I appreciate your attention to this matter and look forward to your response on how you intend to address these concerns.
