I am writing to express my outrage at Congress’s willful failure to stop Immigration and Customs Enforcement from openly defying the United States Constitution. ICE is now claiming the authority to enter private homes without a judicial warrant, and Congress—fully aware of this—has chosen to do nothing. Recent disclosures show that ICE agents are being instructed via internal memo that “administrative warrants” issued by ICE itself are sufficient to force entry into a person’s home. This is not a legal loophole. It is not a gray area. It is a blatant lie. An agency cannot issue its own warrant and then claim constitutional authority to break into someone’s residence. That is the definition of authoritarian policing. This policy has already been tested and failed in court. In Minneapolis, ICE agents forcibly entered a home using one of these administrative warrants. A federal judge ruled that the entry violated the Fourth Amendment. Despite this ruling, ICE continues to assert the power to ignore the Constitution, and Congress has failed to intervene. Let’s be absolutely clear: The Fourth Amendment does not contain an exception for immigration enforcement. It does not permit executive agencies to invent their own warrants. It does not allow warrantless home entry simply because a person is accused of a civil immigration violation. The home is the most protected space in American law. This has been settled for generations. The fact that ICE is now pretending otherwise is alarming. The fact that Congress is allowing it is unforgivable. Congress has the power to stop this immediately. You control funding. You control oversight. You control statutory authority. You can compel testimony, issue subpoenas, pass corrective legislation, and shut down unconstitutional practices. Instead, Congress has chosen silence—effectively granting ICE permission to operate above the law. That silence makes Congress complicit. History does not look kindly on legislators who stood by while constitutional rights were stripped away by executive fiat. The excuse that “the courts will sort it out” is cowardice. Oversight is not optional. It is your job. So I am demanding answers: Why has Congress not acted to immediately halt ICE’s unconstitutional home-entry policy? Why has there been no emergency oversight hearing or public condemnation? Why are you tolerating an agency that believes it can override the Constitution with an internal memo? If ICE can break into homes without judicial warrants today, then the Fourth Amendment is already dead in practice—kept alive only as a ceremonial talking point while Congress looks the other way. This is not about immigration. This is about whether the Constitution still limits federal power. If Congress will not enforce those limits, then it has surrendered its authority and betrayed its oath. I expect a direct response explaining what specific actions you will take to stop this abuse immediately. Anything less will confirm that Congress is knowingly allowing constitutional violations to continue. Do your job.
