As your constituent, I urge you to demand the removal of Todd Blanche as Acting Attorney General. The Senate Judiciary Committee was scheduled to vote on his nomination on July 30. That vote didn't fail—it was pulled the night before after Republican Senators John Cornyn and Thom Tillis refused to advance it without changes to an IRS settlement protecting Trump's family from tax liability. The committee acknowledged the nomination currently lacks the votes to succeed. There is no rescheduled date, and the Senate is leaving for a lengthy August recess. Mr. Blanche is not confirmed. He does not have the votes. Yet he continues to run the Department of Justice anyway. This directly threatens the rule of law for four critical reasons: - It bypasses Advice and Consent: The Framers established Senate confirmation as an absolute check against unilateral presidential rule over the justice system. An indefinite acting appointment, with no vote in sight and his own party unable to advance him, evades that core check entirely. - It threatens legal chaos across the federal judiciary: Every major policy decision, prosecution, and directive issued by an unconfirmed Acting AG gives defense attorneys and courts immediate grounds to challenge their legal legitimacy, opening the justice system to endless litigation. - It ignores thorough vetting that proved his severe conflicts render him unfit: Mr. Blanche's personal attorney-client relationship with Donald Trump remains active by his own admission, and he faces pending state bar disciplinary complaints after a federal judge found a lawsuit tied to his settlement deal was brought in bad faith. - It inflicts real-world harm on equal justice: Lacking constitutional legitimacy, an acting leadership operating under executive mandate actively destabilizes the DOJ—prioritizing retaliatory prosecutions and state-level interference while dropping critical cases and driving away nonpartisan career lawyers. The American people need a real Attorney General—one who serves the Constitution and the public interest rather than shielding a president or operating as a partisan proxy. An unconfirmed appointee whose record has disqualified him to the point that even his own party can't find the votes to confirm him cannot be allowed to sit indefinitely at the head of the Department of Justice. If Mr. Blanche cannot secure Senate confirmation, he cannot continue to exercise the full powers of that office. I ask you to use every tool available—including public pressure for a floor vote, oversight hearings, and support for legislation clarifying time limits on acting service at the DOJ—to bring this constitutional deadlock to a resolution.
