Remove Unjust Compensation for Senators in Government Funding Bill

To: Sen. Padilla, Rep. McClintock, Sen. Schiff

From: A constituent in El Dorado Hills, CA

November 12

I am deeply concerned about a provision in the current government funding bill that allows senators to sue the government for up to $500,000 if their phone records are investigated without their notice. This provision, which appears to be retroactive, seems tailor-made to benefit eight Republican senators whose records were subpoenaed by special counsel Jack Smith during his investigation into efforts to overturn the 2020 election. This provision is deeply troubling for several reasons. First, it creates a dangerous double standard, placing senators above the law and granting them privileges not afforded to ordinary citizens. If enacted, it would effectively obstruct legitimate investigations and undermine the principle of equal justice under the law. The language, added by Senate Majority Leader John Thune, notably excludes House members, further highlighting its selective nature. It's important to note that the special counsel sought limited phone toll data, not content, and only for the period surrounding January 6, 2021. Claims of 'tapping' phones or 'spying' are inaccurate and misleading. Senator Ron Wyden has rightly criticized this as an 'unacceptable giveaway' of taxpayer dollars. I strongly agree. This provision sets a dangerous precedent. If we applied similar logic to all legal subpoenas or even routine traffic stops, it would cripple our justice system and drain public resources. I urge you to take immediate action to remove this unjust provision from the government funding bill before any vote takes place. Our elected officials should be subject to the same legal processes as the citizens they represent. This attempt to shield themselves from valid legal inquiries while potentially profiting from it is an abuse of power and a misuse of public funds. We need transparency and accountability in our government, not self-serving loopholes. Please stand up for the principles of equal justice and responsible governance by opposing this provision and ensuring it is struck from the bill. The integrity of our democratic institutions depends on your action.
