Texas: Keep Red Flag Laws—Stop SB 1362

I write to express my strong opposition to Senate Bill 1362, the so-called “Anti-Red Flag Act.” This bill would prohibit the recognition, service, and enforcement of extreme risk protective orders (ERPOs) in Texas, even those issued by other states. It would also criminalize the enforcement of such orders and prevent Texas entities from accepting federal funds designated for ERPO-related initiatives . Red flag laws are designed to temporarily remove firearms from individuals deemed a threat to themselves or others, following due process through the courts. These laws have been effective in reducing gun-related suicides and preventing potential mass shootings. For instance, studies in Connecticut have shown a 13.7% decrease in gun suicides following the implementation of ERPOs . In the wake of tragic events like the Uvalde school shooting, it’s imperative that we equip our communities with tools to prevent such incidents. SB 1362 would strip away a critical mechanism for intervention, potentially leaving law enforcement and families powerless to act on credible threats. I urge you to reconsider this legislation and prioritize the safety and well-being of all Texans. Rejecting SB 1362 is a step toward responsible gun ownership and proactive violence prevention.
