As your constituent, I am writing to express deep concern regarding the recent Executive Order, "Progress on the Situation at Our Northern Border". While I understand the need to address challenges at our borders, I fear this Executive Order, in its current form, poses significant constitutional, economic, and diplomatic risks. The notion that trade disputes with a key ally warrant the declaration of a national emergency under IEEPA strains credulity. This action appears to circumvent the constitutional authority of Congress to regulate commerce (Article I, Section 8). Furthermore, granting the executive branch such broad discretionary power to impose tariffs based on vaguely defined criteria sets a dangerous precedent, potentially violating the non-delegation doctrine. The practical impacts of this policy are equally concerning. Tariffs, even paused, disrupt supply chains, harm American businesses reliant on Canadian imports, and ultimately raise consumer prices. Economically, this action risks retaliatory measures from Canada, damaging the vital US-Canada trade relationship, which supports countless jobs and industries on both sides of the border. Diplomatically, it undermines our standing as a reliable partner and weakens cooperation on shared challenges, violating the spirit of the USMCA. The justification for this "national emergency" lacks robust evidence. While cross-border drug trafficking is a serious issue, portraying Canada's efforts as a national security threat requiring emergency powers is a questionable assertion. This approach risks alienating a crucial ally and ignoring existing diplomatic and cooperative channels for addressing border security. Therefore, I respectfully request the following: 1. Congressional Oversight: Demand immediate congressional review and oversight hearings regarding the legal basis and justification for declaring a national emergency and invoking IEEPA in this context. 2. Legality Review: Initiate a thorough legal review of the Executive Order to assess its constitutionality, particularly concerning the Commerce Clause, separation of powers, and potential overreach of executive authority. 3. Diplomatic Engagement: Prioritize diplomatic solutions and enhanced cooperation with Canada to address border security concerns, rather than resorting to unilateral trade measures that harm our relationship. 4. Transparency and Data: Demand transparent data and evidence supporting the claim that Canada's actions constitute an "unusual and extraordinary threat" to justify the invocation of emergency powers. We must address border security with strength and resolve, but also with wisdom and strategic foresight. Weaponizing trade and straining alliances is not the answer. Let's pursue solutions that are both effective and aligned with our constitutional principles and long-term national interests. Thank you for your time and consideration of this critical matter.
