The Agency shall— (1) establish and maintain a secure National Central Intelligence Database linking all federal, state, county, and city criminal record systems; (2) establish and apply one uniform federal standard for eligibility for expungement nationwide; (3) receive, review, and adjudicate petitions for expungement; (4) upon approval, issue a Federal Order of Expungement and direct the purging and sealing of such records from all connected systems; and (5) ensure all connected databases comply and update records to reflect such expungement not later than 30 days after issuance of such order. SEC. 5. ELIGIBILITY. (a) ELIGIBLE OFFENSES — An individual shall be eligible for expungement under this Act if the record— (1) is for a non-violent offense; (2) resulted in charges that were dropped, dismissed, or not prosecuted; (3) resulted in a conviction that was overturned or vacated; or (4) is a juvenile offense. (b) EXCLUSION — Violent felonies and sex offenses are excluded from eligibility under this Act unless specifically authorized by Act of Congress. SEC. 6. COMPLIANCE AND IMPLEMENTATION. (a) MANDATORY COMPLIANCE — All federal, state, county, and municipal agencies maintaining criminal records shall provide secure access to such records and shall fully comply with Federal Orders of Expungement issued under this Act. (b) TIMELINE — (1) The Agency shall commence operations not later than 30 days after the date of enactment of this Act. (2) All compliance actions under subsection (a) shall be completed not later than 30 days after receipt of an order. SEC. 7. AUTHORIZATION OF APPROPRIATIONS. There are authorized to be appropriated such sums as may be necessary to carry out this Act.
